The terms that govern your use of the Health Hertz website and the purchase of our products.

Note for accountant review: These terms are drafted in good faith based on Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2) and general e-commerce best practice. They should be reviewed by a qualified Australian commercial lawyer, particularly the liability limitation clauses and the taxation section, before the business scales significantly.

1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the website at healthhertz.com and your purchase of products from Health Hertz ("we", "us", "our"). By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or purchase our products. We reserve the right to update these Terms at any time; continued use of the website after changes are posted constitutes acceptance.

2. Products and Descriptions

We sell frequency therapy devices (the Ripple and Shimmer) and a digital guide (Health Hertz: An Incomplete Guide to Healing Frequencies). We make every effort to ensure product descriptions, specifications, and images are accurate.

Product images are for illustrative purposes. Minor variations in colour or appearance may occur due to photography and screen calibration differences.

Important — not a medical device. Health Hertz devices are experimental wellness instruments. They are not therapeutic goods, medical devices, or regulated health products under the Therapeutic Goods Act 1989 (Australia) or equivalent legislation in any other jurisdiction. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Do not use these devices as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before using frequency therapy devices, particularly if you have a pacemaker, epilepsy, or other serious medical condition.

3. Pricing and Currency

Prices

All prices on our website are displayed in United States Dollars (USD) unless otherwise stated. Your payment processor (Stripe or PayPal) will convert the amount to your local currency at the exchange rate applicable at the time of transaction. We are not responsible for exchange rate fluctuations or bank conversion fees.

GST (Australian customers)

Health Hertz is an Australian business. Under the A New Tax System (Goods and Services Tax) Act 1999, the following applies to our products:

  • Physical devices (Ripple and Shimmer): These goods are dispatched from China. Under the Low Value Imported Goods (LVIG) framework (effective 1 July 2018), GST at 10% applies to imported goods with a customs value of AUD $1,000 or less. Both the Ripple and Shimmer are priced well below this threshold. As the seller, we are responsible for collecting and remitting GST on these sales to Australian consumers once our annual Australian turnover from LVIG sales reaches AUD $75,000. Until that threshold is reached, GST is not separately collected. Prices shown are the total price payable.
  • Digital guide (EPUB): Digital products supplied to Australian consumers may be subject to GST. The price shown is the total price payable.

Accountant note: GST registration and collection obligations should be reviewed once annual Australian sales approach AUD $75,000. The LVIG rules require overseas sellers to register for and remit Australian GST once this threshold is reached. This section should be updated accordingly.

Import duties and taxes (international customers)

Customers outside Australia are responsible for any import duties, customs fees, or local taxes levied by their country's customs authority upon delivery. These charges are separate from the product price. Please refer to our Shipping & Returns page for country-specific information, including the US import tariff pre-collection and New Zealand clearance fee.

Price changes

We reserve the right to change our prices at any time. The price applicable to your order is the price displayed at the time you complete checkout. Price changes do not affect orders already placed and confirmed.

4. Orders and Contract Formation

Placing an order on our website constitutes an offer to purchase. A binding contract is formed when we send you an order confirmation email. We reserve the right to decline any order, for example if a product is out of stock, if we suspect fraudulent activity, or if there is an error in the product listing.

You must provide accurate and complete information when placing an order, including your correct delivery address and phone number. We are not responsible for failed deliveries caused by incorrect information provided at checkout.

5. Payment

We accept payment via Stripe (credit/debit card) and PayPal (including PayPal Pay Later where available). Payment is required in full at the time of order. We do not accept cash, cheque, or bank transfer for retail orders.

Payment processing is handled by Stripe, Inc. and PayPal Holdings, Inc. We do not store your card details. By using these payment services, you also agree to their respective terms of service.

6. Shipping and Delivery

All physical devices are dispatched from Shenzhen, China via 4PX International Logistics. Estimated delivery times are provided as a guide only and are not guaranteed. We are not liable for delays caused by customs clearance, carrier disruptions, or circumstances beyond our control.

7. Consumer Guarantees (Australian Customers)

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), which forms Schedule 2 of the Competition and Consumer Act 2010. Under the ACL, consumers are entitled to a repair, replacement, or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. Consumers are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits, excludes, or modifies any consumer guarantee, right, or remedy conferred by the ACL that cannot be excluded, limited, or modified by agreement.

For customers outside Australia, your local consumer protection laws may provide additional rights. These Terms do not affect those rights.

8. Returns, Refunds, and Warranty

Change of mind

We offer a 30-day change-of-mind return for physical devices, provided the item is unused and in its original packaging. Return shipping costs are the customer's responsibility. Refunds are processed to the original payment method within 3–5 business days of receiving the returned item.

Faulty or damaged goods

If your device arrives damaged or develops a fault within 12 months of purchase, we will arrange a replacement or full refund at no cost to you. This is in addition to, and does not limit, your rights under the Australian Consumer Law.

Digital products

The digital guide (EPUB) is non-refundable once the download link has been accessed, as the content is delivered immediately upon purchase. If you have a technical issue accessing the file, please contact us and we will assist you promptly.

To initiate a return or warranty claim, please contact us via our contact form with your order reference and details of the issue.

9. Intellectual Property

All content on this website — including text, images, product descriptions, protocol names (including "Sleep Cascade", "Deep Sleep Cascade", and "sequential frequency protocol"), and the digital guide — is the intellectual property of Health Hertz or its content creators and is protected by Australian and international copyright law.

You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent. The purchase of a digital guide grants you a personal, non-transferable licence to read and use the content for your own personal, non-commercial purposes.

10. Limitation of Liability

To the maximum extent permitted by law, Health Hertz's total liability to you for any claim arising from or related to these Terms or your purchase is limited to the amount you paid for the relevant product.

We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, loss of data, or personal injury, arising from your use of our products or website, except where such liability cannot be excluded under the Australian Consumer Law.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Health and Medical Disclaimer

Health Hertz devices are experimental wellness instruments intended for personal exploration and research purposes only. They are not approved, listed, or registered as therapeutic goods by the Therapeutic Goods Administration (TGA) of Australia or any equivalent regulatory body in any other country.

The information provided on this website, including in the digital guide, is for educational and informational purposes only. It does not constitute medical advice, diagnosis, or treatment recommendations. We make no claims that our devices treat, cure, prevent, or mitigate any disease or health condition.

Always consult a qualified healthcare professional before using any wellness device, particularly if you are pregnant, have a pacemaker or other implanted electronic device, have epilepsy, or have any other serious medical condition. By purchasing our products, you acknowledge that you have read this disclaimer and accept full responsibility for your use of the devices.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your purchase will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

For customers in the European Union, United Kingdom, or other jurisdictions with mandatory consumer protection laws, those laws apply to the extent they are inconsistent with these Terms.

13. Privacy

Your use of our website and the personal information you provide when placing an order are governed by our Privacy Policy, which is incorporated into these Terms by reference.
